🧱🔍 EU Regulation 305 in Ukraine: Implementation Status, Market Surveillance, and Updates
The implementation status of EU Regulation 305, specifics of technical regulation, and market surveillance were discussed during the meeting of the CBU Committee on Construction Products, held on July 24, 2025, chaired by Serhii Pylypenko, Deputy Chairman of the Board of Directors of the CBU, CEO of Kovalska Industrial and Construction Group, and a member of the Board of Directors of the CBU.
💬 “It is important to understand where we stand now, particularly in terms of the implementation of EU Regulation 305, namely the Law of Ukraine ‘On the Provision of Construction Products on the Market,’ which was postponed and will come into effect on January 1, 2026. Companies subject to the provisions of this law should already be actively engaging in the process to avoid being late,” reminded Serhii Pylypenko.
The readiness status for the implementation of the Law of Ukraine “On the Provision of Construction Products on the Market” was presented by Olena Voskobiynyk, Director of the Department of Technical Regulation in Construction at the Ministry for Community and Territorial Development of Ukraine.
📜♻️ At present, our task is to implement EU Regulation 305; however, the European Union has already adopted Regulation (EU) 2024/3110. The new Regulation does not radically change the approach to the provision of construction products but expands its scope and introduces important provisions related to reuse, environmental factors, and more. Accordingly, after the practical implementation of EU Regulation 305 in Ukraine, it is planned to update it to Regulation (EU) 2024/3110.
As of now, Ukrainian national legislation has implemented all provisions of EU Regulation 305 with an identical degree of conformity, except for certain national provisions of individual EU countries.
Ms. Voskobiynyk reminded that Ukrainian legislation provides for three types of regulatory technical specifications:
🔹 National standards (DSTU EN) identical to harmonized European standards (hEN) – 531 (the list has been updated in accordance with publications in the Official Journal of the EU).
🔹 European Assessment Documents – 371 (the list has been updated in accordance with EOTA publications).
🔹 National documents of Ukraine on technical assessment (upon manufacturer’s request in cases where no harmonized European standard or EAD applies to the product).
🔍Olena Voskobiynyk explained the procedure for designating conformity assessment bodies, emphasizing that their establishment is entirely a market-driven matter. She also outlined the step-by-step algorithm for manufacturers, noting that the first step is to submit a declaration in the Unified State Electronic System in the Construction Sector (EDESSB).
The issue of reusing construction and demolition waste was also raised. The legislation stipulates the establishment of target indicators that every construction company must meet to ensure the reuse of such waste.
🔬 Specifics of Market Surveillance for Construction Products in Ukraine were presented by Natalia Diuzhylova, Deputy Head of the State Inspectorate of Architecture and Urban Planning of Ukraine (DIAM), who also reminded that all information on market surveillance can be found on the DIAM website.
💬 “The algorithm for drafting a sectoral plan includes risk assessment, market assessment, market monitoring, and evaluation of the international market surveillance system, which contains products that pose a danger. Accordingly, based on all these components, we study our Ukrainian market, identify potential risks, and make decisions on approving the sectoral plan,” shared Ms. Diuzhylova.
She informed about updates introduced on the DIAM website. In particular, a consultation window has been launched for business entities — manufacturers, distributors, and sole proprietors. Now, anyone can submit a request and receive professional advice.
Ms. Diuzhylova emphasized that DIAM’s scheduled inspections are carried out specifically at distributors of construction materials. At the same time, this category of market participants is the least aware of the requirements of the Law of Ukraine “On the Provision of Construction Products on the Market.”
A positive effect can be achieved if manufacturers inform their distributors in advance about inspection procedures, the list of necessary documents, and so on.
🌊 The meeting also addressed critical issues related to drainage systems for efficient infrastructure, described by Volodymyr Oliinyk, Deputy Director of LLC “INFRATECHBUD” and member of the Board of Directors of the CBU. Participants agreed that the full implementation of the Law of Ukraine “On the Provision of Construction Products on the Market” and ensuring market surveillance is essential. This will help guarantee high-quality materials for drainage systems as well as other categories.
Mr. Oliinyk proposed changes to several approaches in material selection. In particular, it is necessary to consider:
💰 TCO (Total Cost of Ownership) — not only the initial purchase cost, but also operating and maintenance expenses, potential losses in case of failure, downtime risks, accidents, and damage to third-party property.
📊 Comparing solutions exclusively by key characteristics in accordance with EN 1433.
📣 Strengthening awareness of the requirements of standards for certain categories of construction products, how compliance is verified, and which documents confirm it.
👷 A separate item on the meeting’s agenda was informing participants about the next steps in developing the State Vocational Education Standard for the profession of Concrete Worker.
The development is being carried out by the Confederation of Builders of Ukraine in partnership with the Public-Private Partnership for Improving Vocational Education in Ukraine project, supported by Swisscontact.
✔️ Oleksandr Chervak, CEO of the CBU, announced that CBU has begun collecting proposals from representatives of the construction industry for the current State Vocational Education Standard for the profession of Concrete Worker (SVES 7123.2 FO.45.21-2008).
As part of preparing the professional standard for the Concrete Worker profession, an initiative group and a working group will be formed to prepare substantive proposals for the standard and ensure their approval.
Participants held a series of discussions, following which CBU will send a request to the Ministry for Communities and Territories Development of Ukraine for clarifications regarding the implementation of the provisions of EU Regulation 305.
CBU will continue to work on identifying problematic issues and submitting proposals for shaping the construction products market.
