🖨️ New Public Procurement Law: How the Work of the Construction Business Will Change

🏗️ As part of the CBU Business Day on June 18, 2026, a special block "Rebuilding by the New Rules: What the New Public Procurement Law Changes for the Construction Business" took place. The speaker was Olesia Romanenko, lawyer, Managing Partner of Olsten Partners, and a member of the CBU. She presented the key innovations of the new Law of Ukraine "On Public Procurement," which was voted on April 28, 2026, and is currently awaiting the signature of the President of Ukraine.

During her speech, the speaker emphasized that the new version of the law significantly changes the operational rules for the construction market and provides for increased transparency, control, and compliance in the field of procurement.

💬 "The state is changing the rules of the game. Businesses need to study the new requirements in detail, prepare thoroughly, and gradually implement new approaches into their operations," emphasized Olesia Romanenko.

🗓️ In particular, the law stipulates that all changes will take effect 9 months after its entry into force. It also provides new deadlines for conducting open tenders: 15 days for the procurement of goods, 20 days for works, and 30 days for procurements exceeding EU thresholds.

⚡ Olesia Romanenko paid special attention to the mechanism for automatically determining an abnormally low price. The electronic system will independently identify bids that are significantly lower than market averages or the bids of other participants.

In addition, the new law enhances the transparency of information regarding the cost of construction materials and the execution of works.

Other key changes include:
🔹 strengthened control over subcontractors;
🔹 the possibility of holding market consultations with recorded communication;
🔹 mandatory anti-corruption compliance for procurements over UAH 20 million;
🔹 implementation of dynamic purchasing systems for large-scale projects;
🔹 the customer's right to reject companies that failed to fulfill previous contracts.
