📕 The Government has introduced a mechanism to appeal refusals of urban planning conditions and restrictions
On April 24, 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 527 "On Amending Resolution of the Cabinet of Ministers of Ukraine No. 722 of June 24, 2022," which introduces a mechanism for appealing refusals to provide urban planning conditions and restrictions (MUO) during martial law. From now on, a developer can file a complaint with DIAM via the Unified State Electronic System in the Construction Sector (EDESSB) or the "Diia" portal if they consider the refusal unjustified.
Key changes include:
🔹 An official procedure for appealing decisions on the refusal to issue MUO has been established;
🔹 DIAM will review such complaints through chief construction supervision inspectors, with a processing period of up to 20 working days;
🔹 If the refusal is confirmed to be unlawful, the developer can proceed with design and gain the right to register a notification or obtain a construction permit without the MUO, provided the project complies with urban planning documentation;
🔹 DIAM is granted the right to request documents and materials related to the contested decision from architecture authorities; urban planning and architecture bodies are required to provide such materials within 3 working days.
📍 At the same time, the new provisions will not apply in cases where urban planning documentation already contains a complete geospatial database developed in accordance with legislative requirements.
