🌐Webinar on "International Public Procurement of the United Nations and the United States"

On March 18, 2024, the Confederation of Builders of Ukraine together with the legal company Dictio, a member of the Board of Directors of the CBU and Poland-U.S. Operations Sp. z o. o. held a webinar on "International Public Procurement of the United Nations and the United States".

👤Moderator Olena Shtohryn, managing partner of the legal company Dictio, a member of the Board of Directors of the CBU, started the webinar by noting that foreign companies are already actively participating in UN and US public procurement, and Ukrainian business should not miss such opportunities. 

👤The speaker was Anastasiia Vasylenko, director of logistics at Poland-U.S. Operations, external expert of the Entrepreneurship and Export Promotion Office on international tenders, co-author of the manual on US military tender purchases for Polish companies and lecturer of a series of seminars commissioned by the Ministry of Economic Development and Technology of Poland.

During the webinar, the peculiarities of public procurement by the United Nations (UN) and the United States of America (USA) and the possibility of Ukrainian companies to join this process were considered.

📜Anastasiia Vasylenko presented the basics of international contracting and the current course of UN projects in Ukraine, which are financed through the Partnership Framework Program of the Government of Ukraine.

She described in detail the process of preparing documents for participation in international tenders and demonstrated work on the United Nations Global Market online platform - the UN tender platform.

Anastasiia Vasylenko informed about the main types of tender applications:

🔹Invitation to Bid (ITB) 

🔹Request for Proposals (RFP) 

🔹Request for Quotation (RFQ) 

🔹Low Value Acquisition (LVA) 

🔹Individual Consultant (IC) 

🔎Anastasiia Vasylenko presented various approaches to researching the international market, in particular, requests for information, expressions of interest and pre-qualification. So, each request has its own characteristics and requires the preparation of various documents and the submission of various information.

She emphasized that US purchases are defense-oriented. They are regulated by a number of regulatory documents:

📜Federal Acquisition Regulations (FAR) 

📜Defense Federal Acquisition Regulation Supplement (DFARS) 

📜Buy American Act 

📜Small Business Administration (SBA) 

💻Also, the external expert of the Entrepreneurship and Export Promotion Office on international tenders presented the US tender purchasing platform - System for Award Management.

Anastasiia Vasylenko described the main types of requests for information and the expediency of their application for researching one or another market parameter. In addition, she listed the features, advantages and disadvantages of the main types of contracts:

💰Firm-Fixed Price (FFP) contract

💰Cost-Reimbursement contract

💰Contract with indefinite delivery and indefinite quantity (Indefinite Delivery/Quantity - IDIQ)

💰Basic Ordering Agreement (BOA)
