⚡Euroharmonization of the Construction Products Market in Ukraine: Implementation Status and Innovations
On March 11, 2025, during the first block of the CBU Business Day, participants discussed the implementation of European legislation in Ukraine, particularly EU Regulation 305/2011, and what to expect from the newly adopted Regulation (EU) 2024/3110.
✔️The event was held in a hybrid format, bringing together over 100 participants from active Ukrainian and international businesses.
👤Oleksandr Chervak, CEO of the CBU, moderated the event. He introduced the speakers and provided details on the discussion topics.
Mr. Chervak announced the Recovery Construction Forum Ukraine 2.0, scheduled for April 16, 2025. The event will include three key discussion blocks:
🔹restoration Of The Housing Stock: Balancing The Needs Of The State, Communities, And Businesses;
🔹reconstruction Of Critical And Social Infrastructure: From Comfort To Security;
🔹investment In Recovery: Potential For Communities And Businesses.
He invited all interested parties to join the Recovery Construction Forum Ukraine 2.0 and take part in discussions on Ukraine’s reconstruction.
👤Tetiana Sytnyk, Head of the B2B and strategic research department of the CBR company, spoke about cement demand in Ukraine and presented a consensus forecast for the cement market development in 2023–2027.
Tetiana Sytnyk noted that, according to industry experts, the demand for cement after the war is expected to average 10 million tons per year, with potential peak demand reaching 12 million tons annually.
She emphasized that the introduction of state market surveillance for construction products and the implementation of Regulation (EU) 305/2011 will prevent counterfeit cement and low-quality imports from entering the market.

👤Kveta Kabatnikova, Seconded National Expert, DG GROW, Unit H.1 Construction, spoke about the new EU construction products regulation.
The newly adopted Regulation (EU) 2024/3110 replaces the current Regulation (EU) No. 305/2011. While the fundamental principles of both regulations remain largely the same, several new elements have been introduced.
Among the key innovations of Regulation (EU) 2024/3110 are new regulatory aspects, including the mandatory Declaration of Environmental Performance. These characteristics will be specified in a special product passport, which will also outline the obligations of economic operators, including online marketplaces.
Additionally, the new regulatory elements include:
✔️Harmonized standards based on performance indicators, product requirements (DA), and product information (Annex IV);
✔️Mandatory declaration of environmental characteristics;
✔️Life cycle assessment in accordance with EN 15804;
✔️Verification by a notified body under system 3+;
✔️A declaration of performance that can be provided in digital format, with a mandatory digital product passport to be introduced in the future;
✔️Updated obligations for economic operators, including online marketplaces.
💬“It is important to understand that there will be a rather long transition period where both regulations will coexist and function in parallel,” Kveta Kabatnikova stated.
She also shared links with useful recommendations for businesses.
👤 Olena Voskobiynyk, Director of the Department of Technical Regulation in Construction at the Ministry for Community and Territorial Development of Ukraine, provided an update on the implementation of Regulation (EU) No. 305/2011 in Ukraine.
Currently, in Ukraine, Regulation (EU) No. 305/2011 has been implemented through the Law of Ukraine "On the Provision of Construction Products on the Market," whose national framework includes all key documents prescribed by European regulation.
Regarding the actual state of implementation, Ms. Voskobiynyk noted that legislation provides for 531 national standards with an identical level of conformity to European harmonized standards for construction products.
One of the important aspects of implementing the provisions of the new Regulation is the ability for Ukrainian manufacturers to use regulatory technical specifications.
Olena Voskobiynyk emphasized that as of January 2025, 200 declarations of construction product performance indicators have already been registered in the Unified State Electronic System in the field of construction (UDESC).
She presented the system’s development dynamics. Since 2023, there has been a steady increase in the number of declarations, and currently, the Ministry for Community and Territorial Development of Ukraine is working on improving the functionality of UDESC so that these declarations can be completed using software tools.
👤 Yevhen Doilnytsyn, Deputy Head of the Standardization, Analysis, and International Cooperation Department – Head of the Analysis and Standardization Policy Division, Ministry of Economy of Ukraine, stated that national standardization efforts in the field of building materials and construction are among the most active, thanks to experts and businesses participating in these processes.
💬 “As of today, the European Commission is reviewing Regulation (EU) 1025/2012 on European standardization. This means that the Ministry of Economy of Ukraine anticipates changes in European legislation, and after this, an analysis of our national legislation will be conducted to introduce amendments and align it with European law,” said Mr. Doilnytsyn.
He added that the business sector plays a crucial role in European integration in the field of standardization and encouraged community representatives to participate in the work of technical standardization committees. This, he noted, allows business entities to familiarize themselves with future rules even during their drafting stage.
👤 Valentyna Yanovych, Head of the Technical Regulations and Conformity Assessment Department, Ministry of Economy of Ukraine, stated that in the process of implementing the new Regulation, the Ministry of Economy of Ukraine is responsible for establishing the infrastructure of conformity assessment bodies.
💬 “Even in this part of the implementation, we have encountered many issues. This is due to the fact that the required number of designated conformity assessment bodies is insufficient, and there are certain gaps. A solution had to be found. For now, together with the Ministry for Community and Territorial Development of Ukraine, we plan to address this issue through a draft law that has already been submitted to the Verkhovna Rada of Ukraine. I must admit, our proposed solution is not the best, but for now, no alternative has been found. We propose recognizing the results of conformity assessments conducted by European notified bodies for those areas where Ukraine lacks designated conformity assessment bodies,” said Ms. Yanovych.
👤 Natalia Diuzhylova, Deputy Head of the State Inspectorate of Architecture and Urban Planning of Ukraine, spoke about the specifics of market surveillance of construction products.
Thus, market surveillance and state control are carried out for manufacturers and distributors of construction products.
The verification of construction product characteristics is conducted in the following locations:
🔸 in the commercial and warehouse premises of business entities;
🔸 in places where the product is put into operation;
🔸 at fairs, exhibitions, demonstrations, or other forms of product showcasing;
🔸 in storage areas under customs control where the customs clearance of the product has been suspended based on product control results;
🔸 at the location of the market surveillance authority.
Ms. Diuzhylova emphasized the importance of careful labeling of products with a conformity mark, which indicates that the product meets the declared indicators and all applicable requirements.
👤 Pavlo Kachur, Head of the "Ukrcement" Association, noted that the amount of cement available for Ukraine’s reconstruction will be sufficient.
“Last year, the Ukrainian cement industry exported 1.7 million tons of cement to the EU, meaning this cement can easily return to the Ukrainian market if needed,” Mr. Kachur stated.
👤 Ljudmyla Kripka, Executive Director of the "Ukrcement" Association, shared the experience of implementing technical regulations and EU directives by Ukrainian cement manufacturers.
She stated that cement producers have access to all translated European harmonized standards and are currently working on product labeling and informing consumers about the intended applications.
💬 “I want to note that in addition to Regulation (EU) No. 305/2011, another European directive applies to us. This is the Technical Regulation on the safety of chemical products (REACH),” Ms. Kripka pointed out.
👤 Gennadiy Farenyuk, Director of the State Enterprise "State Research Institute of Building Constructions”, emphasized that the implementation of new innovative technologies must comply with certain regulations.
In particular, any new innovative technology must meet existing safety requirements for buildings and structures. These requirements are established by relevant laws, norms, and standards.
Additionally, Gennadiy Farenyuk outlined the procedure for assessing product acceptability. Specifically, the conformity assessment body and the technical acceptability determination body process the request, provide the manufacturer with the necessary documents, after which the manufacturer’s declaration of construction products is compiled in accordance with legal requirements.
👤 Volodymyr Kaskiv, Deputy Director on Scientific Work of the State Enterprise "National Infrastructure Development Institute”, spoke about the implementation of innovations in infrastructure restoration within the framework of Technical Regulation (EU) No. 305/2011.
He emphasized that a large number of standards in Ukraine do not comply with European legislation and called on the Ministry for Community and Territorial Development of Ukraine to review the existing standards.
Mr. Kaskiv also noted that the implementation of innovations in construction can be accelerated through active communication (via the Innovation Portal and Platform), regulatory framework development (creating the necessary legal basis for innovation implementation), and scientific and technical support.
