🏛️Legislative Initiatives for the Development of the Construction Sector

 

Legislative amendments aimed at advancing Ukraine’s construction industry were thoroughly discussed during the meeting of the CBU Committee on Regulatory and Legislative Activities held on 29 May 2025.

 

👤Olha Sydorchuk, Chair of the CBU Committee on Regulatory and Legislative Activities, Head of the law firm SEMPRA LAW, and Member of the Board of Directors of the CBU.

 

The Committee addressed the following issues:

 

✔️Amendments to the list of activities encouraged under the Diia.City legal regime.

 

✔️Amendments to the Criteria for identifying enterprises, institutions, and organizations of national economic importance in the aviation and automotive transport sectors, tourism, and construction during special periods.

 

✔️Issues related to developer contributions to local infrastructure development.

 

✔️Improvements to the Unified State Electronic System in the Construction Sector (USESCS) — collection of proposals.

 

💬“The goal of our work is to create equal conditions for the development of the construction business by ensuring stability and transparency of the market rules. This is essential for both attracting investment and the effective recovery of the country,” noted Olha Sydorchuk.

 

🔷Amendments to the list of activities encouraged under the Diia.City legal regime

 

The Committee reviewed an initiative from the Ministry of Digital Transformation of Ukraine regarding the draft resolution of the Cabinet of Ministers of Ukraine: “On Amendments to the List of Activities Encouraged under the Diia.City Legal Regime”, developed to allow companies engaged in engineering activities involving the development of design documentation using Building Information Modeling (BIM) technologies to obtain Diia.City resident status in accordance with Paragraph 12, Part Four, Article 5 of the Law of Ukraine “On Stimulating the Development of the Digital Economy in Ukraine.”

 

The proposed draft resolution was supported without any objections.

 

🔷Amendments to the Criteria for identifying enterprises, institutions, and organizations of national economic importance in the aviation and automotive transport sectors, tourism, and construction during special periods.

 

The Committee discussed challenges related to recognizing as critically important those enterprises engaged in construction or developing construction project documentation that are not included in the register of expert organizations. It was decided to develop appropriate proposals and submit them to the Ministry for Communities and Territories Development of Ukraine for further consideration.

 

🔷Issues Regarding Developer Contributions to Local Infrastructure Development

 

Participants analyzed in detail the situation following the enactment of the 2019 law abolishing developer contributions and the transition period in 2020. It was noted that companies that began construction during this period faced difficulties. Despite the removal of the obligation to enter into contribution agreements, local authorities and the prosecutor's office are filing lawsuits to recover funds allegedly retained without legal grounds.

 

Special attention was given to the legal uncertainty that emerged after the mandatory developer contributions were officially repealed in 2021. The legal position of the Supreme Court of Ukraine was discussed, which states that, in the absence of a signed agreement, the developer must return funds retained without sufficient legal justification. This issue remains significant for both developers and local communities as it directly affects infrastructure funding.

 

🔷Improvements to the Unified State Electronic System in the Construction Sector (USESCS): Proposal Collection

 

The meeting addressed technical issues and operational challenges faced by developers, designers, and contractors when using USESCS. The need to enhance the system to simplify document registration and facilitate smoother workflows for market participants was emphasized.

 

Participants discussed the importance of improving user convenience, eliminating technical malfunctions, refining the interface, and ensuring data transparency for all stakeholders involved in the construction process. Attendees were encouraged to submit proposals and report any deficiencies or suggestions for improving the functionality of USESCS.

 

📈It was also highlighted that there is a pressing need to improve legislative acts to encourage growth in the construction sector, increase transparency, and reduce bureaucratic obstacles.

 

💬“We must understand that Ukraine’s recovery requires not only financial resources but also a clear and fair legislative environment that supports business development and community interests,” added Olha Sydorchuk.
