💻On February 9, 2024, another webinar was held on the CBU platform on the topic "Special property rights for future real estate objects: practical points of registration in the SESCS" (ЄДЕССБ)

👤Olga Sydorchuk, head of Sempra Law, a member of the Board of Directors of the CBU, was the speaker of the webinar.

The webinar consisted of two separate parts: consideration of the Law of Ukraine "On guaranteeing property rights to real estate to be constructed in the future" and practical points of work in Single Electronic System in the Construction Sector (SESCS).

So, the webinar participants discussed the following issues:

🖇The concept of future real estate objects.

🖇What is a special property right?

🖇Who is a construction developer?

🖇Guarantee share: what is it and how to register it?

It was also considered whether all construction customers should work according to Law No. 2518-IX and register special property rights for future real estate objects and whether there are exceptions. It was also analyzed what mandatory steps must be taken by a developer who received a permit by October 10, 2022, but in the future plans to sell future real estate objects.

📋Olga Sydorchuk also provided legal advice on how to draw up a contract between the construction customer and the developer correctly and what points should be taken into account.

There were discussed possible schemes for the sale of future apartments/non-residential premises, as well as the consequences of non-compliance with such schemes, the possibility of sales and raising funds through cooperatives.

💻The participants of the webinar received practical experience of entering project documentation into the SESCS and defining its constituent parts (future real estate objects), as well as creating a document on the guarantee share, applications for registration of special property rights.

For construction customers who received a permit by October 10, 2022, advice was provided on how to correctly update data in the SESCS in order to subsequently submit an application for registration of special property rights.

The lively discussion at the webinar once again confirms that the topic of implementation of the Law of Ukraine "On guaranteeing property rights to real estate to be constructed in the future" is relevant for the construction business.
